Connected products are items that can generate, obtain, or collect data about their use, performance, or environment and that can communicate this data via a cable-based or wireless connection. These products together compose a network known as the Internet-of-things (IoT).
The EU Data Act is a horizontal piece of legislation that aims to promote and enhance fair data access and use among stakeholders (including consumers, businesses, and government bodies) across all sectors of the economy, encouraging innovation and individuals’ control over their data.
Published in the Official Journal of the EU on 22 December 2023, the Regulation entered into force on 11 January 2024, with application date for chapters III and IV sets on 12 September 2025.

The main actors under the Data Act are:
- Data User – Natural or legal person that owns, rents or leases an IoT product or receives a related service
- Data Holder – Natural or legal person that holds and can enable access to data ((e.g. manufacturer of a connected product/ provider of a related service)
- Data Recipient – Natural or legal person who receives data from a data holder, including third parties at the user’s request
A contract between a data holder and user is needed to define the rights regarding the access, use and sharing of the generated data.

Data in scope of the EU Data Act and subject to mandatory data-sharing obligations are all raw and pre-processed data generated from the use of a connected product or a related service that is readily available to the data holder. Highly enriched data are out of scope.
Data holders can choose to grant direct and /or indirect access to the readily available data.
- Direct access means that data are available without a request to the data holder.
- Indirect access means that data are only available under a request to the data holder.
When a data holder receives a request to access data, it must identify the trade secrets that need to be shared and agree with the user/third party on the necessary measures to preserve their confidentiality.
The Data Act is fully compliant with the GDPR (General Data Protection Regulation) and GDPR rules on the protection of personal data always prevail in the event of a conflict between the GDPR and the Data Act.
